Fetal Death – negligent exam leads to premature rupture of membranes at twenty-one (21) weeks of gestation:
Case Facts: During the course of her pregnancy, our client sought out medical attention for cramping and spotting. After calling her obstetrician, who advised that she need not worry about these ‘common problems,’ she went to a local area hospital-based health care center. The care giver at that facility first confirmed that the baby in our client’s womb had a good heart beat. This same care giver then proceeded to perform an examination with a speculum. Immediately the client’s membranes ruptured. The care giver is reported to have then stated, “Oh, you must have been dilated.” The client then went into immediate labor and gave birth to her child, who died as a result of prematurity (at 21 weeks, a fetus usually cannot survive).

Again, the above ‘cases under investigation’ are just that – under investigation. At Nash & Associates, we recognize that bad results can occur even when the medical care is totally proper. We believe it is our ethical duty to our clients to totally and properly investigate these matters to identify those cases in which tragic outcomes are the result of negligence. Of course, the ultimate determination of the validity of a case lies with the jurors who must unanimously agree that our assessment was correct.
