Endometriosis – failure to timely diagnose
Case Facts: Our review of the currently available medical records has led us to pursue investigation of this potential claim. It is our current view and analysis that our client demonstrated clear signs and symptoms of a not uncommon but disabling condition that afflicts women - endometriosis. Once again, despite multiple reports of signs and symptoms which should have led to timely and thorough investigation as to the cause of these complaints, the health care provider failed to take timely action. As a result of the delay, it appears that the client’s endometriosis was allowed to progress to a point where the disease was allowed to spread to this woman’s fallopian tubes (causing complete blockage), with extension into her diaphragm. She has now suffered a loss of fertility and suffers the ongoing effects of extensive disease in her body.

Again, the above ‘cases under investigation’ are just that – under investigation. At Nash & Associates, we recognize that bad results can occur even when the medical care is totally proper. We believe it is our ethical duty to our clients to totally and properly investigate these matters to identify those cases in which tragic outcomes are the result of negligence. Of course, the ultimate determination of the validity of a case lies with the jurors who must unanimously agree that our assessment was correct.
