Wrong Level Spine Surgery

Case Facts: Nash & Associates obtained a confidential settlement on behalf of a client whose neurosurgeon performed a diskectomy and fusion on the wrong level of the patient’s spine. The surgeon, realizing his error, continued to perform the diskectomy & fusion at the correct level. In doing so, we claimed, he prolonged surgical and anesthesia time, as well as misplacement of instrumentation resulting in an injury to the patient’s epiglottis. Essentially, the patient was left unable to adequately swallow, unable to eat anything other than liquefied foods, and the diskectomy & fusion failed to improve the patient’s back pain.
